Who you can claim for
Non-dependants
Non-dependants are people who normally live with you such as friends and relatives, for example, adult sons and daughters and elderly parents. But the following people are not treated as non-dependants: [Legislation (59)]
- a member of your family (see ‘Claiming for your family’)
- or if you are polygamously married, any partner or dependent child
- or a child or young person living with you for whom you cannot get Income Support (see previous page)
- or a person with whom you jointly rent or own your own home, unless that person is a close relative
- or a tenant, sub-tenant, landlord, member of the landlord’s family or lodger, unless that person is your close relative
- or a carer engaged by a charitable or voluntary body who stays with you to look after you.
If there is a non-dependant living with you, he or she will not affect your personal allowances. But it may affect the amount of money you get to cover your housing costs or your entitlement to a severe disablement premium.
